Terms & Conditions

These Terms & Conditions govern your use of Benkyou Academy (the "Service"). The Service is operated by Zzale Sagar, trading as Benkyou Academy("we", "us"). By creating an account or continuing to use the Service you agree to these terms. If you are under the age of majority where you live, a parent or guardian must agree on your behalf.

1. The Service

Benkyou Academy is an online study platform providing curriculum content, homework planning, practice tests, AI-generated study guides, quizzes and essay feedback, plus gamified progress features such as XP, levels, streaks, leaderboards and cosmetic items.

2. Your account

  • You must provide accurate information and keep it up to date.
  • You are responsible for keeping your login credentials confidential.
  • You are responsible for all activity that happens under your account.

3. Acceptable use

You must not misuse the Service. In particular, you must not:

  • use the Service for any unlawful purpose;
  • commit fraud, send spam, or manipulate XP, quiz scores or leaderboard standings;
  • infringe anyone's intellectual property rights;
  • interfere with the security of the Service, including uploading malware, probing or scanning our systems, scraping, or bypassing technical limits;
  • resell, redistribute or reverse engineer the Service.

4. AI-generated content

  • Study guides, quizzes, practice questions and essay feedback are generated automatically and may be inaccurate or incomplete. Always verify important information.
  • You are responsible for what you submit as prompts or essay text, for having the rights to any content you submit, and for how you use the output.
  • You must not use the Service to generate illegal content, hate speech, harassment, deepfakes, malware, or to attempt to bypass safety measures.
  • Output is for study support only and is not professional, legal, medical or financial advice.
  • We may remove or restrict content, filter or refuse outputs, and suspend accounts that break these rules. Rights holders may contact us at support@benkyouacademy.app to request removal of infringing content; repeat infringement leads to account termination.

5. Intellectual property

We retain all rights in the Service, including its software, curriculum structure, artwork, cosmetics and branding. You receive a limited, non-exclusive, non-transferable right to use the Service within your selected plan. You keep ownership of the content you submit and grant us a limited licence to host and process it solely to provide the Service.

6. Memberships and payment

Paid memberships (Plus and Pro) are billed monthly and renew automatically until cancelled. Payment, billing, taxes, invoices, cancellation and refund mechanics are handled by our reseller — see Paddle's Buyer Terms and our Refund Policy.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Memberships never grant XP, coins that affect the leaderboard, leaderboard rank, quiz scores, or the Gold, Silver and Bronze champion rewards. Those are earned only through study.

7. Service level

We work to keep the Service available, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

8. Suspension and termination

We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time. On termination you may request an export of your data for 30 days, after which it may be deleted.

9. Liability

To the extent permitted by law, our aggregate liability is limited to the fees you paid in the 12 months before the claim, and we are not liable for indirect or consequential loss including lost profits, data or goodwill. Nothing excludes liability for fraud, death or personal injury caused by negligence.

10. General

You indemnify us against claims arising from your content, your unlawful use, or your breach of these terms. You may not assign these terms without our consent; we may assign them in connection with a merger or acquisition. Neither party is liable for delays caused by events beyond reasonable control. These terms are governed by the laws of the jurisdiction in which Zzale Sagar is established, and its courts have exclusive jurisdiction.
